Welcome to Knutsford Veterinary Surgery’s Gold Plan.

This Contract, between you and Knutsford Veterinary Surgery, means you can enjoy the benefits of the gold standard preventive healthcare for your pet(s) offered by Knutsford Veterinary Surgery on the terms set out herein (Gold Plan).

The following provisions make up the ’terms and conditions’ of your Contract with Knutsford Veterinary Surgery and are effective from October 13, 2016 and are the conditions on which you are entitled to the benefit of the Gold Plan. These terms and conditions are legally binding and we strongly advise that you read through them carefully before storing them in a safe place for future reference.

These terms and conditions should be read in conjunction with the Gold Plan Leaflet and/or website information as these documents form part of these terms and conditions. In the event of a conflict, the terms of the Gold Plan Leaflet will prevail.

1. Explanation of terms used

In this Contract, ‘the Company’, ‘us’, ‘our’ and ‘we’ means Knutsford Veterinary Surgery, which is the trading name of Paws Direct Limited (company number 07856473), whose registered office is at Fryers Nursery, Manchester Road, Knutsford, Cheshire WA16 0SX; ‘The Contract’ means these terms and conditions, the terms set out in the Gold Plan Leaflet and any other contractual terms between you and the Company which you have signed; ‘you’ means the Payment Plan holder who has signed up to the Gold Plan.

2. Duration

This Contract is for an initial term of one year commencing on when you join the Gold Plan. Thereafter, the Contract will automatically renew every 12 months, unless you give us notice to terminate the Contract is accordance with Condition 10.

2. Plans, categories and fees

The cost, content and delivery of the goods and/or services paid for by this Contract are notified to you by the Company from time to time.

3. Treatment to which you are entitled

The Contract entitles your pet to receive the treatment included within the Gold Plan to maintain your pet’s health, as prescribed by us. A list of inclusions is available from the Company on request.

4. Treatment to which you are not entitled

The Gold Plan only entitles your pet to the routine preventive healthcare treatment required to monitor its health, as specified in the Gold Plan Leaflet.

5. Treatment by another veterinary practice

Your Contract is with us. Routine care or treatment provided by anyone other than the Company will not be covered by your Gold Plan.

6. Payment

You must pay your monthly fee for the Gold Plan by Direct Debit in favour of Go Cardless Ltd as our collecting agent.

Any other amounts due to us for treatment not covered by the Gold Plan are payable directly to the  Company. Your liability to pay the monthly fee continues until the Contract is ended in accordance with these terms and conditions and no refund or waiver of fees will be allowed except in the case of our administrative error or death of the pet or client.

7. Alteration of monthly fees and categories

We will conduct an annual review our fees for the Gold Plan, usually in August each year.

We also reserve the right to increase our fees during the course of each year so as to reflect any changes in the cost of medicines charged to us by our suppliers.

Should our fees, or any other terms of the Contract, change, you will be given at least one month’s notice.

8. Direct Debit changes

Where you are given notice of an increase in your monthly fee, your Direct Debit will be changed at the end of the notice period, unless in the meantime you end the Contract. Following a decrease in monthly fee or variation in discount available to you, your Direct Debit will be changed at the next available collection date.

9. Your responsibilities

You are responsible for ensuring your pet(s) attend(s) the practice regularly and that you comply with the advice and treatment the Company prescribes for your pet(s). Products included in the plan must be collected within 2 months of treatment becoming due, unless the Company notify you otherwise in writing. If, in the reasonable opinion of the Company, it is not able to maintain your pet’s health due to any act or omission on your part, the Company may end the Contract immediately by giving notice to that effect.

If your personal details change, you should notify us. If your pet is lost or deceased, you should notify the company immediately.

10. Ending the Contract

You may cancel your Contract by contacting us within the cooling off period, which is 14 days following the start of your Contract. Following this period, you may end the Contract by giving not less than one month’s notice to the Company, expiring on the anniversary of joining the plan. The Company may end the Contract by giving you written notice expiring on the last day of a month, after no less than one month’s notice, or by giving immediate notice as otherwise set out at Condition11(b) below.

11. Non-payment

(a) Non-payment of one fee.

  • If we are unable to collect a monthly payment we will inform you accordingly and attempt to collect two payments from your account in the following month.

(b) Non-payment of two fees

  • If you default on two successive payments, we will inform you your Contract has been subsequently cancelled.

12. Variation of these terms and conditions

The terms and conditions of this Contract and the services offered to you as part of the Gold Plan may be varied on one month’s written notice given to you by the Company. If you do not wish the Contract to continue having regard to any variation notified to you, you may end it as detailed in condition 10. If you do not do this by the time the notice expires, you will be deemed to have accepted the variation.

13. Contract not transferable

This Contract is between you and the Company and is non-assignable by you. The Company may assign this Contract by giving you notice of it’s intention to do so.

14. Treatment outside the Contract

This Contract does not prevent you and the company agreeing that we will provide treatment outside your entitlement under the Contract. You will be responsible for paying for such treatment.

15. Disputes

If you are unhappy with any aspect of your pet’s veterinary care provided under the Gold Plan, you should let us know as soon as possible. We will work with you to resolve any dispute, wherever possible, to our mutual satisfaction.

16. Notices

Any notice given by the company is valid if sent to your last known address by ordinary post or by e-mail to the e-mail address provided to us by you.

It is your responsibility to ensure that this information remains up to date, and the Company is notified of any changes to your postal or e-mail address(es) from time to time.

17. Your personal data

The Company may record and monitor telephone calls for training purposes and for use in the event of any subsequent queries.

The main purpose for which we hold and use personal data is to enable us to administer the Gold Plan. Other purposes for which we use personal data is for market research, to improve our services to you and our other customers, to comply with legal obligations which we are subject to. to protect our interests and for fraud detection and prevention.

Whilst administering this Plan, we may receive and share personal data with:

  • Persons appointed by the Plan holder and/or Power-of-Attomey for a period of time

For example, the pet’s owner when different to the Plan holder.

Where we have your agreement, we will use your personal data to provide you with offers of products and services of the company.

18. Governing Law and Jurisdiction

Both parties agree that this Contract shall be governed by and construed in accordance with the Law of England and Wales and the parties hereby irrevocably submit to the exclusive jurisdiction of the English Courts.
